Terms of Service

These Terms of Service ("Terms") govern your access to and use of GuestNet, a hospitality guest feedback and review management platform operated by Virtucom / Marz Innovations LLC ("we", "us", "our"). By creating an account, activating a property, or using any part of the service, you agree to these Terms.

1. The Service

GuestNet provides software for hotels and hospitality operators to collect guest feedback through QR-code-scanned forms, route positive feedback to public review platforms, intercept negative feedback for internal resolution, and generate AI-drafted response suggestions to guest reviews. The service includes an admin dashboard, optional email and SMS alerting, and integrations with third-party review platforms (Google, TripAdvisor, Yelp, Booking.com).

2. Account Eligibility

You must be at least 18 years old, authorized to act on behalf of the property you register, and able to enter into a binding contract. Each property activation creates a unique digital identity (Glitch ID) and license credential. You are responsible for maintaining the confidentiality of these credentials. You must not share, sell, or transfer your account.

3. Subscription and Billing

Access to the service is provided on a subscription basis. Fees, billing cycles, and tier features are presented at the point of purchase or activation. Subscriptions renew automatically unless cancelled. Refunds are not provided for partial billing periods.

4. SMS Alerts and Consent

The service offers optional SMS alerts to property managers when negative feedback is submitted. By entering a mobile phone number in the GuestNet admin dashboard, you affirmatively consent to receive operational SMS messages at that number from GuestNet.

6. Review Routing and Third-Party Platforms

The service may direct guests with positive feedback to leave public reviews on third-party platforms (Google, TripAdvisor, Booking.com, Yelp, etc.). These platforms have their own terms governing what is and is not acceptable review-solicitation behavior. You are responsible for ensuring your use of GuestNet is consistent with the terms of any third-party platform you connect. We do not guarantee that any review submitted through our routing will be published or retained by a third-party platform.

7. AI-Drafted Responses

The service uses third-party AI models (including but not limited to Anthropic Claude) to generate suggested response drafts to guest reviews. All drafts are suggestions only — you are responsible for reviewing, editing, and approving any response before it is posted publicly. We do not guarantee the accuracy, appropriateness, or completeness of any draft, and we are not liable for content posted using draft suggestions.

8. Data and Privacy

Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. Guest feedback submitted through your property's QR code is stored on our infrastructure and made available to you through the admin dashboard. You are responsible for ensuring your use of guest data complies with applicable privacy law in your jurisdiction.

9. Intellectual Property

The GuestNet software, design, and trademarks are owned by us. Content you provide (property names, knowledge base entries, response drafts you write or edit) remains your property. By providing content, you grant us a limited license to host, process, and display it as needed to operate the service for you.

10. Disclaimers and Limitation of Liability

The service is provided "as is" and "as available." We do not warrant that the service will be uninterrupted, error-free, or that AI-drafted content will always be appropriate for use. To the maximum extent permitted by law, our total liability for any claim arising out of or related to the service is limited to the amount you paid us in the 12 months preceding the claim.

11. Termination

You may cancel your subscription at any time through the admin dashboard or by contacting us. We may suspend or terminate access for breach of these Terms, non-payment, or use that endangers the service or other users. On termination, your access ends and your data may be retained for a reasonable period to permit recovery before deletion.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-product notice. Continued use of the service after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Idaho, USA, without regard to its conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Idaho.
